Pennsylvania Prenuptial Agreement

This Prenuptial Agreement (hereinafter referred to as the "Agreement") is made and entered into on this ______ day of _______________, 20__, by and between ___________________ (hereinafter referred to as "Party One") and ___________________ (hereinafter referred to as "Party Two"), collectively referred to as the "Parties".

WHEREAS, the Parties intend to marry, and in consideration of such marriage and the mutual promises and covenants contained herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties wish to establish their rights and obligations regarding each individual’s assets and liabilities.

NOW, THEREFORE, in consideration of the forthcoming marriage, and in consideration of the mutual promises and covenants contained herein, the Parties agree as follows:

  1. Disclosure of Assets and Liabilities: Each Party has fully and accurately disclosed to the other Party all their respective assets and liabilities on Exhibit A and Exhibit B attached hereto, made a part hereof.
  2. Separate Property: Each Party shall retain all rights, title, and interest in and to their separate property, as defined by Pennsylvania law, free and clear of any claim by the other Party.
  3. Marital Property: The Parties may acquire property jointly during the marriage, which shall be considered marital property and subject to distribution as agreed by the Parties or as determined by a court of competent jurisdiction under Pennsylvania law.
  4. Alimony and Support: The rights to seek alimony or spousal support are hereby waived by each Party, except as they may otherwise agree in writing or as provided under the laws of the State of Pennsylvania.
  5. Amendment and Revocation: This Agreement may only be amended, modified, or revoked by a written instrument signed by both Parties.
  6. Governing Law: This Agreement shall be governed by, and construed in accordance with, the laws of the State of Pennsylvania, without giving effect to any choice or conflict of law provision or rule.
  7. Severability: Should any provision of this Agreement be held invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement.
  8. Entire Agreement: This Agreement constitutes the entire agreement between the Parties pertaining to its subject matter and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, of the Parties.
